Response to decision by Constitutional Court

The Constitutional Court has unanimously confirmed that the articles of the ZBan-1 that formed the basis for the Bank of Slovenia’s extraordinary measures of 2013 and 2014 are in accordance with the constitution. The measures imposed on banks by Bank of Slovenia decisions on extraordinary measures are likewise in accordance with the constitution, and are not in any way challengeable.
The Constitutional Court confirmed that holders of subordinated instruments may exercise judicial protection solely by lodging claims for damages, which were also envisaged by the ZBan-1, and gave additional guidance to the legislator in this part to ensure more effective judicial protection.
